Terms of Service

1. Agreement

These terms apply when you use this website or engage Gentech Solutions TZ ("Gentech", "we", "us") for software, website, mobile app, branding, cloud or marketing services. For client projects, a signed proposal or service agreement takes priority over these general terms where they differ.

2. Services and subscriptions

• Software systems (POS, hotel, school ERP, microfinance) are provided as subscriptions billed monthly or annually, as agreed in your plan.
• Setup, training and data migration are included where your plan says so.
• We provide support via WhatsApp, phone and email. Critical issues are prioritised.
• Subscriptions renew automatically until cancelled with notice as set in your agreement.

3. Payment

Prices are quoted in Tanzanian Shillings (TZS) unless stated otherwise. Payment is accepted via mobile money, bank transfer or cash with receipt. Late payment may lead to suspension of service after reasonable notice.

4. Your data

Data inside your system — sales, students, loans, guests — belongs to you. If you leave, we will export your data in a standard format on request. How we handle personal data is described in our Privacy Policy.

5. Our responsibilities

• We build and maintain services with reasonable skill and care.
• We target high availability for hosted systems but cannot promise uninterrupted operation of the internet, mobile networks or third-party services (e.g. mobile money, SMS gateways).
• We keep your business information confidential.

6. Your responsibilities

• Keep your login credentials secure and manage staff access sensibly.
• Use the services lawfully and provide accurate information.
• Pay agreed fees on time.

7. Intellectual property

Gentech retains ownership of its software platforms, code libraries and know-how. You receive a licence to use the system for your business while your subscription is active. Custom work (e.g. your logo, your website content) that you paid for in full belongs to you.

8. Liability

To the extent permitted by Tanzanian law, our total liability for any claim connected to a service is limited to the fees you paid for that service in the twelve months before the claim. We are not liable for indirect losses such as lost profits.

9. Termination

Either party may end a service as set out in the service agreement. We may suspend or end service for non-payment or unlawful use after reasonable notice. On termination, your data export rights in section 4 apply.

10. Governing law

These terms are governed by the laws of the United Republic of Tanzania. Disputes will first be addressed in good faith negotiation; failing that, in the courts of Tanzania.
